Information Use

Procedure to use human rights counseling center and rectification procedure

Human rights infringements shall be reported only using a real name, but the personal identity of a reporter is strictly secured. The Center also implements the actions to prevent secondary damages. The Center will notify the results as soon as possible after the investigation on the reported cases. However, inaccurate or false reports may not be investigated.

  1. Receipt of report in Human Rights Counseling Center

    • Receipt of report by visiting, mail, calling, fax or email
    • Prepare the ¡®Human Rights Infringement Report¡¯ when reporting human rights infringement cases (Download)
    • Counseling with the human rights management officer
  2. Preliminary investigation on the cases received

    • Supplementing the report of a case (the contents to report are not specified)
    • Rejection of a report (closing a case)
      1. ¨ç Not supplemented within 14 days.
      2. ¨è Cancellation of a report
      3. ¨é Reporting anonymously or by fake name
      4. ¨ê Lapse of over 1 year from the date of report on infringement
      5. ¨ë In case of the definite false report
      6. ¨ì External rectification procedure in progress/closing a case.
      7. ¨í Victim doesn¡¯t want investigation.
      8. ¨î Repetition of the same case
      9. ¨ï Improper purposes of reporting
      10. ¨ð Judgment by the Committee
  3. Classification and transfer

    • (Human Resource Team) Sexual harassment/violence/work place bullying/li>
    • (Legal Affairs Team) Code of conduct/other human rights infringement
    • (Auditor¡¯s Office) Anti-corruption report/whistleblowers/ civil complaints/others
    • (National Human Rights Commission of Korea, investigation agencies and other institutions) When investigation by a higher authority is immediately required)
  4. Counseling, investigation and measures to protect victim

    • Case investigation (including site investigation, document check and sample collection)
    • Preparation of investigation report
    • Closing
      1. Suspension of investigation (including unknown whereabouts, impossible investigation, investigation not required)
      2. Settlement during investigation (including agreement or cancellation of report)
  5. Deliberation on investigation results and resolution by Human Rights Management Committee

    • Decision on whether to deliberate investigation results or request supplementary investigation
    • Resolution 1.Rejection 2.Dismissal 3.(Quotation) Recommendation of rectification and correction
      • Suspension and correction
      • Rectification measures including recovery of original state
      • Improvement of laws, institutions, policies and customs to prevent recurrence
  6. Notification of results and implementation of rectification measures

    • Notification of results within 7 days from the date of resolution
    • Establishment of the execution plan of rectification measures within 30 days from the date of resolution
  7. Processing Period

    • Processing within up to 6 months from the date of receipt
    • Including extension of processing period once within 30 days from the date of receipt

Measures to Protect Victims

  • It¡¯s mandatory for KNOC to take the measures to protect victims in order to prevent any secondary damages (Article 33, Human Rights Management Regulations)
  • Counseling or investigation can be requested to an independent expert (Article 31, Human Rights Management Regulations)
  • Decision on rectification measures through deliberation by the Committee for fair treatment.(Article 31-4, Human Rights Management Regulations)
  • Securing the right of a victim and a reporter to request reading or copying of case records (Article 35, Human Rights Management Regulations)

Identity security for a victim and duty of good faith practice

  • Securing confidentiality of a reporter and report details and prohibiting unfavorable disposition on a reporter (Article 33, Human Rights Management Regulations)
  • When a reporter notifies an infringement case while he/she knows or may know that the case is not true, the reporter can¡¯t be protected by the Article 33, Human Rights Management Regulations(Article 29, Human Rights Management Regulations)
